ABSTRACT

This chapter gives an overview of wrongful birth, which aims to recognize civil ‘wrongs’ that have occurred due to negligence that can be traced to the defendant’s action or inaction. Wrongful birth cases tie injury to the existence of some child. Valentine gives an overview of disability studies critique of wrongful birth, noting how it perpetuates ableism and eugenic logic. Valentine examines a case of wrongful birth that centers on race, and argues such cases make it clear that disability and race are not completely separate phenomena.
