ABSTRACT

The tragic events of summer 2020 in Belarus have put its judicial system to the test and subsequently unveiled its flaws. In a democratic state, the judiciary plays an important role and, together with the legislative and executive branches of power, forms a core pillar of a functioning state. Instead, in Belarus, Lukashenka's regime has been using the judiciary system to intimidate and persecute peaceful protesters who took to the streets demanding free and fair elections and calling for the release of political prisoners. This chapter provides an analysis of the current state of the Belarusian judicial system with some prognoses for the future. The chapter examines reforms of the judiciary systems implemented in Georgia and Ukraine, to discuss the lessons that could be learned from Belarus's transition to a democratic judicial system.
