ABSTRACT

In this chapter, I contribute to discussion on whether there is a unique Central and Eastern European legal identity. I suggest searching for a proxy delineating feature of Central and Eastern European legal identity by using the compliance of states with judgments of the European Court of Human Rights. The chapter engages in discussing the behavior of states on the international arena that exposes their actual national interests. It provides a preliminary outlook on the compliance data of Central and Eastern European countries with judgments of the European Court of Human Rights, focusing on non-execution of cases under enhanced supervision of the Committee of Ministers. I try to identify the major trends of non-executed cases and outline ideas for further research.
