ABSTRACT

The chapter comprehensively examines gender inclusion in the Argentinian constitutional and legal framework and practice. We begin with a historical account of women’s exclusion in the 1853 Constitution and their gradual incorporation from the middle of the twentieth century. Then, we continue with an analysis of the incorporation of gender equality and a gender perspective in the Argentinian constitutional framework through the constitutional reform of 1994. We also review the different administrations’ public policies in this area. Finally, the chapter seeks to approach the interpretation of gender equality clauses: what has been done and what has been lacking to incorporate and effect gender equality in Argentina.
