ABSTRACT

This conclusion presents a closing thoughts on key concepts discussed in this book. The book explores the various legal mechanisms of divergence and convergence that can help establish (and upset) this dynamic balance. It offers a constitutional vision providing a common language that can serve the communication between legal systems, rather than surrendering to the idea that different legal orders are bound to talk past each other. The book then moves from broader concepts to more precise tools, instruments, and mechanisms of convergence and divergence. It shows how the distribution of competences in the foreign policy sphere, an area in which both the EU and the Member States are empowered to act, led the CJEU to apply different strategies to avoid and, if necessary, resolve the conflicts between unity and diversity. The book argues that national and European economic constitutions impact one another in a reciprocal relationship.
