ABSTRACT

Although the dimensions of the democratic backsliding in Romania, particularly between 2016 and 2020, have been lesser than in other Member States of the EU, significant deviations from the standard of the rule of law can be noticed, which is the reason why the Cooperation and Verification Mechanism introduced by Decision 2006/928/EC of 13 December 2006 is still in place. Despite this factual reality, as of recently, the Romanian Constitutional Court seems to be opposing the internalisation of the EU standard of the rule of law and refuses to acknowledge the primacy of EU law. Under these circumstances, the interaction between the RCC and the ECJ needs further corrections in order to become a judicial dialogue.
