ABSTRACT

This chapter reviews the unique status of tribal administrators, with a background on the challenges to tribal sovereignty posed by Supreme Court jurisprudence and the operation of federal Indian law. With that background, consistent with this volume’s Lilliberation approach, the chapter then reviews various tribal administrative procedure ordinances to demonstrate how tribal governments are constructing new legal frameworks to support the administration of their governance. Finally, the chapter draws lessons from these examples and offers an exercise for students and instructors to explore the intricacies of this field.
