ABSTRACT

Personal injury is one of the great areas of modern law that aims to protect legal subjects, i.e. natural persons. The need to understand, recognise, and compensate for this type of damage, especially in its most radical form of ‘damage to the Life Project’, both at the Peruvian as well as the Inter-American Court of Human Rights, is very important. In Peru, personal injury is recognised as compensable damage under the 1984 Civil Code. The role of the Italian legal culture has been relevant in the development and interpretation of Peruvian law. In the area of tort law, especially personal injury, the contribution of Pier Giuseppe Monateri, who has long studied damages for personal injury, stands out. This essay analyses how Monateri’s work and research have influenced the treatment of personal injury in Peruvian law.
