ABSTRACT

The chapter contains the analysis of how the Constitutional Tribunal understands the duty of consistent interpretation of national law with EU law. This chapter also shows how the principle of consistent interpretation and various notions of the EU law are seen in the Polish constitutional jurisprudence. This chapter also presents various consequences of the principle of consistent interpretation in Polish constitutional law. This means, in particular, that this competence of the CT is considered as an instrument of the protection of the rights of individuals, an instrument of the dialogue with the ECJ, as well as the instrument of the breakdown of the relationship between the Polish CT and the CJEU.
