ABSTRACT

International law is seen as a field that develops through the actions of States, principally through their executive and legislative branches. The relationship of the judicial branch—of municipal courts—with international law is often overlooked. And yet, municipal courts regularly engage with international law, applying and even creating it. Focusing on India, this chapter discusses the interactions of Indian courts with international law. It concludes with a brief discussion on how attempts to strengthen international law must account for the pivotal role municipal courts can play in its development.
