ABSTRACT

The European Green Deal (EGD) insists that one of the main deficits of European Union (EU) Environmental Law is its lack of or insufficient implementation. Therefore, it states that one of the main objectives is to ensure its effective enforcement. The EU Commission has been playing an important role in keeping the EU strong in defending the implementation and enforcement of environmental legislation. Lack or insufficient enforcement of environmental legislation does not happen only at the EU level, but it is also one of the main problems at the international level and it is also reiterated at the State level. This chapter will verify the extent of the lack of enforcement of EU environmental legislation, as well as of international legislation and State legislation in relation to the requirements set by the EGD. The main causes of this situation and its negative effects will be analysed. Some proposals are then made to better ensure the enforcement of environmental legislation and the role of the EU in its formulation and implementation, within the EU and its Member States and outside the EU. It will also pay attention on how to make information on the environmental law’s compliance available and accessible to the public.
