ABSTRACT
Divergent arguments have been put forward to evaluate the post-apartheid legal order in South Africa. This chapter contextualizes these arguments in order to understand the legacies of apartheid and colonialism and the impact of these legacies on the evolution of a post-apartheid legal order.
