ABSTRACT

This chapter examines real rights less than the right of full ownership which are recognised and regulated by the new Civil Code of the People's Republic of China. Such rights created over the property of another and enforceable against the whole world are known to civil law jurisdictions as subordinate real rights, limited real rights, or dismemberments of rights of ownership. The list and content of such rights help distinguish the civil law and common law traditions and assess the national legal systems within each of the two major legal traditions.
