ABSTRACT

The United Nations Convention on the Law of the Sea is a living treaty. As such, questioning the Convention's place in the current climate change matters is of utmost importance. To what extent can the Convention and the climate regime interact to address climate change issues? This study focuses on Parts XII and XV of UNCLOS. Ocean-climate litigation is a means to assert the importance of states’ general obligation to protect the marine environment, especially from climate change's adverse effects. This study aims to analyse the opportunity of ocean-climate litigation to strengthen states’ commitments to mitigate climate change.
