ABSTRACT

This chapter considers the general approach adopted by the Review which led it to recommend such a radical mode of trial agenda. It focuses on the proposed "hybrid" tribunal for the middle tier of jurisdiction, the new modes of trial proposed for serious offences and the recommendations that are designed to make juries more accountable for how they behave and for the decisions which they reach. The Review's willingness to accept the need for radical changes in order to promote justice, efficiency and public confidence and to look beyond traditional practices within the jurisdiction is characterised by its approach towards modes of trial and trial procedures. The idea of structured questions for juries together with other suggested reforms on jury trials such as providing juries with a more substantial opening statement from the judges, copies of the indictment and a case and issues summary could similarly be rolled out on an experimental basis.
