ABSTRACT

Immanuel Kant has become exceptionally popular in the anglophone world. This chapter provides a framework for approaching and understanding Kant's Doctrine of Right. Kant's building blocks are seven parallel sets of three concepts, the parallel nature of which remains constant throughout the Doctrine of Right. The first set includes the concepts 'possibility', 'reality', and ' necessity'. The Second set includes three formulae adapted from Ulpian. The Third set includes three states: 'the original state', 'the adventitious state', and 'the juridical state'. The Fourth set includes three leges: 'lex iusti', 'lex iuridica' and 'lex iustitiae'. Fifth set includes three attributes: 'right', 'juridical', and 'established as right'. The Sixth set includes three types of legal duties: 'internal legal duties', 'external legal duties', and 'those legal duties'. The Seventh set includes three types of public justice: 'protective justice', 'justice in mutual acquisitions', and 'distributive justice'.
