ABSTRACT

The first international body created by States was perhaps the Administration general de l'octroi de navigation du Rhin, which was established by the Treaty of August 15, 1804 between France and the Holy Roman Empire. It was not until the early twentieth century after the First World War with the creation of the League of Nations and the International Labor Organization, which were open organizations, that the issue of the international legal personality of international organizations came seriously to be discussed. The status in international law of international organizations has for some time been fertile ground for text writers though there have been few international judicial decisions or opinions that have faced the subject directly or indirectly. The issue of legal capacity and personality in municipal law is different. Whether personality is recognized in municipal law will depend primarily on the municipal legal system and law concerned.
