ABSTRACT

This chapter aims to assess the international mechanism for the avoidance and settlement of transboundary environmental disputes in the special context of the geographical sphere-East Asia. That is to say, environmental disputes, though transboundary or transnational, which were settled by domestic mechanisms are not dealt with, the focuses is on transboundary disputes between or amongst nation States. China signed a large number of such bilateral agreements with other Asian countries on various environmental matters ranging from general cooperation in the environmental fields to specific matters of environmental protection and natural resources conservation. There are two major efforts in East Asia at the multilateral level in term of environmental dispute control: the combat of Indonesian haze in Southeast Asia and the management of the Mekong River region. The efforts made at fighting the Indonesian haze are another example of how to environmental disputes are controlled in East Asia.
