ABSTRACT

This chapter considers the great issues related to public law and public administration. The great issues are interesting to both theorists and practitioners, have been sources of controversy, and are enduring. The chapter discusses the several great issues these are the legal foundations of administration, the role of courts, the development of administrative law, the extent of regulation and Legal influence on administrative practice. The legal foundations of public administration are expressed in the classic definition of public administration as the execution of the law. Scholars have thoroughly considered how constitutional origins affect the legitimacy of public administration, but most of the discussion is focused at the federal level. The chapter considers constitutional cases; appellate courts and administration; the rule of law philosophy; trials, litigation, and costs; and alternatives dispute resolution processes. The roots of scholarship on public administration can be traced to F. J. Goodnow 1893 work on administrative law.
