ABSTRACT

For many years, malicious hackers seemed primarily interested in harming the computers they accessed or using those computers as a platform for launching attacks on still other computers. In recent years, however, hackers have shifted their behavior as they, too, have come to recognize the value of the information stored in electronic form on computers connected to the Internet. Congress has already made some types of voyeuristic hacking a crime and is considering legislation to expand that universe of crimes. The explosion of wireless Internet technology has completely transmogrified the nature of Internet use and the threats posed by voyeuristic hackers. Internet enthusiasts and local policy makers have made great strides in blanketing pockets of several cities in wireless access points or hotspots. The statutes making it a crime to obtain information vary, depending on whether the information is obtained on a real-time basis or is retrieved from a computer's storage.
