ABSTRACT

A change of residence or accommodation is possibly the most common reason for a formal capacity assessment. This could be regarding discharge destination from hospital or a change of accommodation within the community. The level of care required may influence and restrict the options available for accommodation. In case law, making decisions about where to live and about care needs are seen as separate with different relevant information attached to each; however, these decisions can often influence each other. Case law sets guidance relating to the information the person would need to be able to understand, retain, use and weigh to make an informed decision. In this case, it would be good for the person to be able to visit the specific care homes in order to give her as much information as possible before the assessment.
