ABSTRACT

This chapter explores the philosophical underpinnings of key remedies for contractual misrepresentation and specifically the inter-relationship of those remedies, with particular reference to the Consumer Protection from Unfair Trading Regulations 2008 as amended by the Consumer Protection Regulations 2014. The concept of a 'misleading action' under Consumer Protection from Unfair Trading Regulations 2008 is not necessarily reflected under the general law of misrepresentation. Overall the law of misrepresentation can be viewed as a complex crucible of laws and regulation which, to link back to the title of this collection, are not always coherent and integrated. A more restrained approach to damages for negligent misrepresentation is evident at least at common law. The law of contractual misrepresentation is a law of interfaces. There is, for example, the interface between common law, equity and statute; as well as an interface between tort and contract laws. Jill Poole, of course, made many contributions to developing integrated, coherent and modern frameworks for contract law.
