ABSTRACT

This chapter proposes to group them into three categories depending on the object of the contract, that is, depending on the primary purpose of the contractual relationship: a delegation of responsibility, a purchase of services, and, cooperation. There are numerous typologies for contractual relations: some are based on the nature of the contract, others on the actors involved, and others on the scope of the contract. A private organization, which owns its structures and possesses its own resources, collaborates, is associated with and performs a “ public service mission” Under contract with the State, it thus becomes a public service concessionaire. Individual fundholders may decide themselves to purchase the health services they require from a health services provider. Privatization is a concept that at first sight appears simple. According to the dictionary definition, privatization involves the transfer of ownership of an entity from the public to the private sector, its opposite being nationalization.
