ABSTRACT

The idea of parliamentary supremacy was established after the Glorious Revolution in 1688-1689. Ever since that event, political power and constitutional supremacy has been located in and even centralised to the British Parliament. The Lord Chancellor especially underlines the lack of protection against the state itself which is inherent in the traditional British conception of a right and the traditional view on unlimited parliamentary supremacy. Since Israel is in the process of adopting a formal constitution, the United Kingdom is probably the only Western democracy without a written constitutional document, which has a superior status in relation to ordinary laws. The fundamental shift in the position of the Labour Party is particularly interesting. In the early 90’s, this party was deeply suspicious about the contribution of judges to civil liberties and even more suspicious of letting courts handle controversial political issues.
