ABSTRACT

The Japanese Obstetric Compensation System for Cerebral Palsy (JOCS-CP) was launched in response to the deteriorating perinatal care system in Japan. Traditionally, the reasons for occurrence of cerebral palsy has been poorly understood. However, its existence can evoke conflict between family members and physicians. The Japan Medical Association (JMA) has studied the potential of introducing a no-fault compensation system for cerebral palsy since the early 1970s. Investigation is one of the major pillars of JOCS-CP that aims to not only prevent cerebral palsy but also to mitigate conflict and bring it to an early settlement. Whether or not to include an assessment of the preventability of cerebral palsy was one of the most controversial issues faced by the Investigation Committee at its inception. The investigational reports are aggregated and systemically analysed by the Prevention Committee to generate knowledge for improving quality in obstetric/perinatal care, particularly through the prevention of cerebral palsy.
