ABSTRACT

This chapter explores the process of prosecuting property crime offences. It outlines the investigative process from a prosecutor's perspective and explains how the prosecutor decides whether a case should be prosecuted (including what legal criteria guide this decision and the various legal and extra-legal factors that come into play). The role of the prosecutor and prosecution service are described, including how they work with other agencies during the prosecution process, such as the police and victim support services. This chapter highlights the many challenges, both legal and practical, that a prosecutor faces when dealing with property crime cases and how these are tackled.
