ABSTRACT

This chapter explores the main laws which apply to the role of the manager and to provide the basic foundation of understanding upon which they can develop their more detailed knowledge. Laws derive from two main sources: firstly statutory provision, i.e. Acts of Parliament and regulations or legislation from the European Community, and secondly the decisions in cases decided by the courts. Primary legislation often gives powers to a minister of the Crown to make further more detailed regulations. Managers can obtain further information about the Articles from the dedicated task force set up by the Department of Constitutional Affairs (DCA). The DCA provides an update on the most recent cases where the significance of the Articles has been discussed as well as an explanation of the Articles. The statutory duties are paralleled by duties in respect of health and safety owed at common law by both the employer and employee.
