ABSTRACT

This introduction presents an overview of the key concepts discussed in the subsequent chapters of this book. The book seeks to gain an understanding of the state of consumer sales law in a selection of jurisdictions from around the world. Opting a case-scenario approach, the book designs two factual (and fictional) scenarios about a consumer who has acquired something and encounters various post-purchase problems. The first scenario is a familiar scenario based around a motor vehicle with various issues, whereas the second reflects a more recent phenomenon: digital content. The purpose is to discover whether possible differences in the design of the legal rules on consumer sales would invariably mean that this would also produce different outcomes in concrete cases, or whether there would be a high degree of congruence irrespective of the legal rules at issue.
