ABSTRACT
In a first step I would like to discuss the constitution and political system in Berne before 1798. Empirical observations will follow in a second step, and will then be put into a theoretical context with statehood (Staatlichkeit). Finally, I will reflect on the heuristic potential of the category of common property (Gemeinbesitz).1
