ABSTRACT

This chapter discusses the past and present legislative amendments of the Visa Waiver Program (VWP) in relation to the European Union's effort for full inclusion of all the Member States. It also discusses the VWP process of reforms throughout the years. The Visa Waiver Program was initially established as a temporary program called the Visa Waiver Pilot Program by the Immigration Reform and Control Act of 1986 (IRCA). Under the Visa Waiver Permanent Program there are many conditions that third countries must meet in order to be nominated for admission. First the State Department needs to notify the Justice Department of its intention to nominate a country for designated country status. The United States Visitor and Immigrant Status Indicator Technology, US-VISIT was initially established to keep track of foreigners on their visits in the US, their immigration status as well as type of visas they have.
