ABSTRACT

This chapter explains the effectiveness of the measures does not carry very far; the governments are well aware that the deported Bulgarian and Romanian Roma have the right to return the following day. The situation in Romania and in the Czech Republic has not been seriously considered in France and Italy in order to avoid creating difficulties inside EU Member States. It has been more or less the same with the Canadian government. Contemporary governments don't want judges of other jurisdictions to have their say in international diplomacy through the questions of minorities, foreigners, asylum seekers and violations of human rights. Let's begin with the example of expulsions of Roma coming from Romania and Bulgaria, but also from Hungary, by Italian and French authorities in 2010 and 2011. They were illegal, especially those coming from Romania and Bulgaria, as under Schengen rules, the provisions concerning free movement of persons and workers in Europe did not apply to these two countries.
