ABSTRACT

Employee fraud can cause businesses much more harm than just the monetary value of the fraud. All employees should have a contract of employment, crucial in terms of what one might want to do in relation to, for example, accessing PCs or desk drawers, but it should be remembered that the contract cannot take away the rights mandated by law. Thus, when dealing with whistleblowers, it should be remembered that they may have the protection of the law through the Public Interest Disclosure Act 1998 (PIDA) but you have to consider if the whistleblower is an employee of one company and therefore should be afforded all the protection that PIDA offers. The Criminal Route is worth remembering that the police control their processes and, while they might arrest and caution prior to interview all involved, they might only proceed with a limited number to face charges.
