ABSTRACT

This chapter describes how the individuals are handled and treated once they enter prison and await execution. It includes living conditions on death row, housing and management issues, and how the correctional facility provides for inmates' specific needs, as well as various constitutional challenges. The chapter presents several fundamental issues inherent in the housing and managing of prisoners under the sentence of death. In fact, the European Court of Human Rights has declared it cruel and torturous punishment in violation of international human rights law. In the United States, the Eighth Amendment protects death row inmates from cruel and unusual punishment. The appellate court recognized that improper lighting impedes sanitation, personal hygiene, and reading and contributes to mental health problems over time. The appeals court, however, vacated the injunction, based on the warden's promise that the whole plumbing and drainage system would soon be revamped.
