ABSTRACT

Displacement and property crimes have been charged and proved in many of the cases prosecuted at the International Criminal Tribunal for the former Yugoslavia (“ICTY”) and early indications from the International Criminal Court (“ICC”) suggest that this court will continue the trend. The following survey demonstrates that while displacement, property and persecutory crimes are legally distinct, there is often a factual coincidence between them. Evidence going to one of these offences will frequently complement and reinforce evidence going to another. Displacement is usually accompanied by the misappropriation and destruction of property and both types of crime are perpetrated on discriminatory bases. Materials that have been forensically significant in proving these types of charge at the international tribunals range from regular witness testimony to public records, laws and regulations, to expert evidence, along with many other sources and pieces of evidence that are discussed herein.
