ABSTRACT

The open attitude of Georgia towards the international legal order affects its approach to the legal instruments and concepts related to European Union-Georgia relations. The Association Agreement is an international treaty and rights and obligations deriving from it are of an 'international law' nature. The membership in international organisations, or relationship to international organisations in whatever form, is constitutionally based on provisions regulating the process of ratification of international treaties. The Constitution conferred a broad authority of judicial review to the Constitutional Court, which is described as the 'judicial body of constitutional control'. The constitutional submission lodged by a district court questioned the constitutionality of an article of the international agreement concluded between Georgia and the International Committee of the Red Cross. The Constitution determines the scope of the exercise of sovereignty by explicitly stating that 'state authority shall be exercised within the ambit of the Constitution'.
