ABSTRACT
Personal injury litigation is a type of civil action based on the law of tort. A tort consists of an injury arising out of the breach of some duty other than a contractual obligation that creates legal liability for the defendant. The existence of such a duty may be established by statute or by common law and is generally dependent on what a “reasonable person” would have done in similar circumstances (Kane & Dvoskin, 2011).
