ABSTRACT
On April 20, the Nationalist government issued an order concerning the protection of human rights. Those who violate the order shall be harshly punished according to the law. In China, the government's conduct basically knows no boundaries based on laws and regulations, and so the people's rights and freedoms also have absolutely no protection based on laws and regulations. If we really want to protect human rights and establishes the rule of law, our first task is to draft a constitution for the Republic of China called as Provisional Constitution for the Tutelage Period. We need a Provisional Constitution to protect the people's physical beings, freedoms, and property. If the human rights set down in this constitution are violated, no matter whether they are violated by the commanders of the 152nd Brigade or by the Nationalist government chairman, the people can be able to bring a complaint to the courts and all must submit to the rule of the law.
