ABSTRACT

This chapter shows that in what ways is marine pollution prevention and control impacted by the so-called human element? What is the significance of the human element, and its practical impact? The STCW Convention is a highly important instrument from the standpoint of the human element, including on the level of maritime safety and marine pollution prevention STCW 2010 includes numerous provisions which are of interest to the protection of the marine environment. The human element should also be addressed from the standpoint of the International Safety Management Code. The Code is aimed at ensuring "safety at sea, prevention of human injury or loss of life, and avoidance of damage to the environment, in particular to the marine environment and to property". The Code has a broad ambition. It seeks to achieve its goals through a first part on implementation-related aspects and a second part on certification and verification.
