ABSTRACT

This chapter examines the regulatory framework of the Audiovisual Media Services Directive (AVMSD) and the extent to which it can apply to the electronic press. It analyses the determinations reached by the British and Austrian regulatory authorities. The chapter talks about the electronic press within the Directive's regulatory framework. It examines the implementation of the AVMSD in the United Kingdom (UK) and Austria and seeks to answer the question of whether the audiovisual material on the websites of print publications can be regulated as an audiovisual media services (AVMS). The chapter focuses on the Sun Video case, but also draws insights from other Authority for Television on Demand (ATVOD) determinations and Ofcom appeal decisions. It describes the Austrian regulators' approach to the regulation of the electronic press under the AVMSD.
