ABSTRACT

I start not with Slavoj Žižek, but with H.L.A. Hart, the most influential Anglophone jurisprude. Hart's positivism may seem impoverished compared to speculative theory. Nevertheless, there are surprising moments of correspondence between Hart's concept of law and Lacanian theory. As such he serves as a foil: a point of comparison to explicate a Žižekian jurisprudence.
