ABSTRACT

This chapter discusses the identification of the right to humanitarian assistance in armed conflict through the framework of international humanitarian law. It reviews the current situation in Syria, the UN Security Council's response to the humanitarian crisis through UN Security Council Resolution and the subsequent implementation of that resolution. It also discusses whether the denial of humanitarian assistance may be considered as a war crime and the implications that the lack of humanitarian access to the Syrian population has for humanitarian action in the future. The chapter explores the issue of humanitarian access in the case of Syria through a reviews of UN Security Council Resolution and an analysis of its impact as reflected in the reports of the UN Secretary-General on the implementation of this resolution. This chapter shows that the denial of humanitarian assistance can constitutes a violation of the rules of international humanitarian law.
