ABSTRACT

This introduction presents an overview of the key concepts covered in the subsequent chapters of this book. The book provides an overview and analysis of decisions by international courts and tribunals that have applied and interpreted legal principles of sustainable development outlined in the 2002 New Delhi Declaration. It examines the historical, political and legal context within international affairs leading to the 2002 pronouncement of the New Delhi Principles. The book then explores the basic characteristics of a global justice system. It also surveys how international courts, tribunals and dispute settlement bodies are currently engaged in resolving disputes on trade and investment related to sustainable development, on human rights related to sustainable development, and on the environment related to sustainable development. The book then discusses the development of the sustainable development principles in the Pulp Mills case, a case which reveals the complexities of sustainable development and the approach of the International Court of Justice (ICJ).
