ABSTRACT

The Republic of Slovenia, located between Austria, Hungary, Croatia and Italy, became an independent state in 1991. Since 2004, it has been a full member of the European Union. After the proclamation of the new constitution in 1991, all legal provisions in force at that time stayed in force, except where they were in conflict with human rights and fundamental freedoms. New legislation, including criminal legislation based on the new constitution, gradually replaced the previous Yugoslavian legal order. A brand new Criminal Code and Criminal Procedure Act entered into force in 1995. The Criminal Code was then replaced in 2008, whereas the Criminal Procedure Act has been amended several times but has not yet been replaced by completely new legislation, although a new Act has been drafted. Both documents are consistent with the European Convention of Human Rights (ECHR).
