ABSTRACT

Originally printed in the San Francisco lesbian periodicalGibbous Rising,this text is a formal response to the antigay initiative sponsored by California State Senator John Briggs, which called for “filing charges against schoolteachers, teacher's aides, school administrators or counselors for advocating, soliciting, imposing, encouraging or promoting private or public sexual acts defined in … the Penal Code between persons of the same sex.”The Bakke decision was a 1978 ruling by the U.S. Supreme Court which overturned race-based affirmative action admissions policies at the University of California.
