ABSTRACT

This Module considers the legal aspects of the “materials and communications” that are associated with administering a construction contract and resolving the claims and disputes that might arise therefrom. “Materials” in this sense stands for matter that is produced through the construction process but which does not form part of the physical built environment—most notably, paper and electronic documentation. “Communications” stands for how such materials are applied—particularly from the standpoint of establishing a contract, managing it, demonstrating entitlement to the contractual claims that arise from it, and resolving the resultant disputes.
