ABSTRACT

A deposition is a procedure for recording witnesses’ oral statements for later use in legal proceedings. Accompanied by counsel, the deponent appears, is placed under oath, and responds to questions from attorneys from both sides of the case. Parties may inquire into any matter that is relevant to the case and is not privileged. Although no judge is present, attorneys may make objections, which a judge will rule upon before the material objected to is used in a trial.
