ABSTRACT

The three countries dealt with in this chapter have been grouped together primarily for reasons of convenience and because, to a very large extent, they share a common legal history. No changes were made to the constitution of Botswana in 1967, though there were several enactments within the general field of constitutional law, particularly in regard to immigration and refugees and the control of public meetings and processions. A recognised refugee may still be removed from Botswana under the provisions of the immigration laws, but only to a country approved by the Minister as one in which, in his opinion, the refugee will not be subject to political persecution. A recognised refugee may, however, leave Botswana at any time, although he ceases to be a recognised refugee on his departure. The Ngwenyama is recognised as the King of Swaziland, and is made Head of State.
