ABSTRACT
This paper discusses the predicament of Oscar Pistorius. He is a Paralympic gold medallist who wishes to participate in the Olympics in Beijing in 2008. Following a brief introductory section, the paper discusses the arguments that could be, and have been, deployed against his participation in the Olympics, should he make the qualifying time for his chosen event (400m). The next section discusses a more hypothetical argument based upon a specific understanding of the fair opportunity rule. According to this, there may be a case for allowing Pistorius to compete even if he should fail to make the official qualifying time. The final part of the paper reviews the situation at the time of writing and offers some assessment of the strategy of the IAAF in responding to it. It is argued below that the proper focus for assessment of Pistorius’s eligibility to compete should not be on whether his blades lead to his having an unfair advantage over his competitors, but instead should focus on whether what he does counts as running.

Este artículo trata del aprieto en el que se encuentra Oscar Pistorius (OP). El es el medallista de oro paralímpico que desea particupar en los juegos olímpicos de Beijing en 2008. Tras una breve sección introductoria, el artículo discute los argumentos que podrían ser, y que han sido, utilizados contra su participación en las olimpiadas caso de que consiguiera la marca mínima requerida para su evento (el 400 m). La siguiente sección discute un argumento más hipotético basado en un entendimiento específico de la regla de justa oportunidad (Rawls, 1970). De acuerdo con esto, puede que sea defendible el permitir que OP compita incluso si el no tuviese eíxito a la hora de conseguir la marca mínima. La parte final del artículo revisa la situación en el momento de escribir este artículo, y ofrece alguna valoración de la estrategia de la Asociación Internacional de Federaciones de Atletismo (AIFA) [International Association of Athletics Federations (IAAF)] al responder a este asunto. En lo que procede se discute que el enfoque apropiado para asesorar la elegibilidad de OP para competir no debe de ser si sus prótesis en forma de "J" conllevan el que tenga una ventaja injusta sobre sus competidores, sino que en vez de esto deberían centrarse sobre si lo que hace se puede clasificar como "correr."

Dieser Aufsatz geht auf das Dilemma von Oscar Pistorius (OP) ein: Der Goldmedaillengewinner der Paralympics will bei den Olympischen Spielen in Beijing 2008 teilnehmen. Nach einer kurzen 27 Einleitung werde ich in diesem Artikel die Argumente diskutieren, die gegen eine Olympiateilnahme sprechen könnten, insofern er die Qualifikationsnorm für seine Disziplin (400m) schaffen sollte. Der nächste Abschnitt behandelt die mehr hypothetische Argumentation um das spezifische Verständnis des Gebots von Chancengerechtigkeit (Rawls, 1970). Demzufolge könnte man OP die Wettkampfteilnahme gestatten—sogar für den Fall, dass er die offizielle Zeit zur Qualifizierung nicht erreichen sollte. Der abschließende Teil dieses Artikels beleuchtet die Situation, wie sie sich zum Zeitpunkt der Abfassung dieses Textes darstellte. Dieser Abschnitt beinhaltet eine eigene Einschätzung zur Strategie der International Association of Athletics Federations (IAAF). Es wird behauptet, dass nicht der Vorteil gegenüber anderen Athleten, die OP die Schaufel/J-förmigen Prothesen verschaffen, im Zentrum der Argumentation um die Teilnahme stehen sollten, sondern vielmehr die Frage, ob seine Art der Fortbewegung überhaupt als „Laufen" bezeichnet werden sollte.
