ABSTRACT

The following is a cross-section of legislative initiatives related to international humanitarian law taken by Commonwealth States in the period 2005-2008.

This Act amends the Geneva Conventions Act to approve the adoption of an additional distinctive emblem and to include the Third Protocol Emblem (Red Crystal) along the emblems mentioned in Article 85, paragraph 3(f) of Schedule V, thus affording it the same protection currently enjoyed by the Red Cross, Red Crescent and, Red Lion and Sun emblems. The Act also amends the Act to incorporate the Canadian Red Cross Society adding a provision which prohibits the unlawful use of Red Cross, Red Crescent and Red Crystal names and emblems and establishes penal and administrative sanctions for this offence. Finally, the Act amends the Trade-marks act by adding the Red Crystal emblem to those marks whose unauthorized use is prohibited.
