ABSTRACT

In Honduras, there have been many human rights mechanisms and bodies that have emphasised the need for some type of instrument that regulates the right to prior consultation of Indigenous Peoples. However, the general context of this country with a highly polarised social climate is a considerable challenge that hinders any dialogue process. In this context, this chapter aims to review the background to and development of the process of dialogue to construct a national mechanism for the prior consultation of Indigenous Peoples in Honduras between 2014 and 2018. This chapter also focuses on the multiple challenges involved in a fair implementation of Indigenous Peoples’ right to consultation and their FPIC, both in terms of national legislation and policies and their practical implementation on the ground.
